Guest Use of Property and Facilities at Grace Farms – Waiver and Release
By accessing the property and use of any of the grounds, facilities, amenities located at 365 Lukes Wood Road, the guest (Releasor) acknowledges that:
1. Release of Claims
The Releasor, on behalf of themselves and any person who may claim through them (including but not limited to heirs, assigns, executors, administrators, and trustees), hereby fully and irrevocably waives, releases, and discharges Grace Farms Foundation, Inc. (the “Foundation”) and its shareholders, directors, trustees, officers, employees, consultants, contractors, advisors, agents, insurers, attorneys, and volunteers (collectively, the ”Released Parties”) from any and all rights, claims, demands, causes of action, damages, liabilities, losses, or expenses—including legal fees and costs—arising out of or related to participation in Foundation activities, services, or presence on Foundation premises (collectively, ”Activities”). This Release does not waive rights that cannot legally be waived. If any portion of this release is found invalid, the remainder shall remain in effect.
2. Indemnification and Hold Harmless
The Releasor agrees to indemnify, defend, and hold harmless the Foundation and all Released Parties—at no cost to the Foundation —from any claims, damages, liabilities, losses, or expenses (including attorney’s fees) arising from the Releasor’s participation in Activities, actions or omissions, or negligence of the Releasor or the Releasor minor child(ren) or conduct while on the premises.
3. Execution on Behalf of Minor Children
If the Releasor acts on behalf of any minor child(ren) who visit the premises or participate in Activities, the Releasor affirms full authority to do so and agrees that all terms of this Release apply equally to such minors.
4. Consent to Use of Likeness
The Releasor understands that their image, likeness, or voice may be recorded during Activities or while on the premises. By participating, the Releasor grants the Foundation a perpetual, worldwide, royalty‑free right to capture, use, publish, edit, distribute, or otherwise exploit such recordings for any lawful purpose without compensation. The Releasor waives any right to inspect or approve the use of such materials.
5. Dispute Resolution
Any dispute arising from this Release or the Releasor’s relationship with the Foundation shall be governed exclusively by Connecticut law. Jurisdiction and venue shall lie only in Connecticut Superior Court or the U.S. District Court for the District of Connecticut. Each party shall bear its own legal fees, except that the prevailing party is entitled to recover all legal fees and costs, including collection expenses.
6. Limitation of Liability
If the Foundation is found liable despite this Release, its maximum liability shall not exceed the total amount the Releasor has paid to the Foundation within the preceding twelve (12) months.
